Terms & Conditions

Any booking made with Jaital.com will be governed by and subject to these Terms & Conditions. Unless otherwise stated, purchases made through Jaital.com and its affiliate web sites are subject to these Terms & Conditions; in all booking arrangements, the person making the booking shall be deemed to have accepted these conditions on behalf of the persons named in the booking.

Prices
Price quotations are subject to change without notice. Tips/gratuities to tour directors, drivers or local guides and other service providers are not included in our prices, and although generally considered appropriate, this is strictly a personal decision.

Payment
Shore Excursions & Tours - Only a small deposit (down payment) is required to hold your space and confirm your booking; Other websites require you to pay the full amount in advance...not us!. To determine the deposit amount, simply add items to your shopping cart. The balance amount will be due on the day of service. Balance amounts are paid in cash or credit card when available. Please contact us to determine the acceptable method of payments for your balance amount. Full payment is also accepted, please contact us to find out if your tour can be paid in advance. If your tour qualifies for full payment and you wish to pay the full amount in advance, a surcharge of 5% will be charged to the total cost.

Airport Transfer - Transfer bookings are paid in full prior to service date. To avoid last-minute fees, we recommend booking 3 or more days prior to service date.

We accept Visa, Master card, Discovery and American Express on our website. Charge will be listed as "Jaital Tours" or "www.jaital.com" on your credit card statement. You will be charged in United States Dollar (USD).

Refund Policy
Full refund will be given for tours that are cancelled 10 or more days prior to scheduled date, unless otherwise specified. If a tour is canceled due to weather or the ship's inability to get into port, it is your responsibility to contact us for a refund. Refunds will not be issued without a reply to the original confirmation e-mail. If you decide, for any reason whatsoever, not to participate in all or part of your scheduled tour or transfer, Jaital.com will not be required to make any refunds. Refunds are made to the booking party only. If payment was made by and through a travel agency, the refund will be made to that entity. The credit card used for payment must be valid at time of refund, refunds will not be processed if the credit card used for the initial payment has expired or invalid.

Airport transfers are fully refundable if cancelled more than 24hrs in advance of scheduled pick-up time. No refunds if cancellations are made less than 24 hours prior to pick-up time. Name changes are not allowed.

Disputed Charges
If there is any dissatisfaction with our services, disputes shall be taken up directly with Jaital.com. Customers who dispute credit card charge by filing chargeback with their card company before contacting us, will be charged an  administrative fee of $50 per case by jaital.com if the chargeback is ruled in favor of jaital.com by the financial institution. If you dispute the charge as not recognized, $50 administrative fee will also be charged per case. In the event of a lawsuit being filed by Jaital.com, the prevailing party shall be entitled to recover attorney's fees and the cost of suit.

Confirmation
Jaital.com will send confirmation voucher by e-mail within 24-72hrs after payment is made. this voucher has to be printed as a proof of purchase and will be presented to the service provider. You must have your voucher, or you will be charged again with no refund. We recommend checking your junk mail box as your email provider may recognize us as spam. In case you have not received your voucher within 24-72hrs, it is your responsibility to notify us prior to your departure by replying to your payment receipt . All information regarding the travelers should be correctly given at the time of booking. Jaital.com cannot be held responsible for any problem that may happen if you don't receive or read carefully your confirmation voucher.

Disclaimer & Limitation of Liability
The liability of Jaital.com and its affiliate web sites (ochoriostour.com, jamaica-tour.com) is limited. Jaital.com acts only as an agent for the passengers in all functions pertaining to tours, attractions, restaurants, meals and services, sightseeing tours and transportation of whatever nature, and assumes no liability for injury, loss, damage, accident, delay or inconveniences which may occur either by reason of defect, or as acts of government or other civil authorities (war, civil disturbances, strikes, etc.) or from any cause beyond Jaital.com control. Jaital.com can accept no responsibility for the loss or additional expenses due to delay or changes in schedule or other causes. Jaital.com and his suppliers reserve the right to vary itineraries in order to improve each tour, to the tour member’s enjoyment and advantage. Jaital.com and its suppliers reserve the right to cancel or rescheduled any tour departure in accordance with operation requirements. Jaital.com reserves the right to refuse booking to anyone at its sole discretion. Jaital.com reserves the right to cancel scheduled tours, transfers and activities at any time in the event of insufficient sales, hazardous weather conditions or unforeseen operational problems.

Any booking made with Jaital.com will be governed by and subject to these Terms & Conditions. No variation to these Terms and Conditions shall be of any effect unless made in writing by and with the authority of Jaital.com.
